These Terms of Service ("Terms") govern your use of the Yapper iOS application and keyboard ("Yapper" or the "App"), provided by Gold Penguin LLC ("Gold Penguin," "we," "us," or "our"). By downloading or using Yapper, you agree to these Terms and the Yapper Privacy Policy. If you do not agree, do not use the App.
1. What Yapper provides
Yapper turns your speech into text on your iPhone and types it into other apps through its keyboard. It includes an optional speech model you can download, text cleanup, a personal dictionary, History, and stats. Yapper is free, with no word limits and no subscription.
2. Personal, lawful use
You may use Yapper for personal and professional purposes that are lawful. You are responsible for having any consent the law requires before recording or transcribing other people. You may not misuse the App, interfere with its operation, or use it to violate another person's rights.
3. Your content
You own what you dictate and the text Yapper produces. It is stored on your device, and you are responsible for keeping any copies you need. We cannot recover History or recordings that are deleted or lost with a device.
4. Transcriptions can be wrong
Speech recognition makes mistakes, including in names, numbers, and specialized terms. Review text before you send, publish, or rely on it. Do not rely on Yapper for medical, legal, emergency, or other situations where an error could cause harm.
5. Speech models and third-party components
Yapper can download NVIDIA Parakeet speech models (licensed under CC BY 4.0) from Hugging Face, and it uses open-source components listed in the App under Settings › Licenses. Apple's speech recognizer is provided by Apple under its own terms. We do not control and are not responsible for third-party services or their availability.
6. Open-source license
Yapper's source code is offered under the MIT License. Where that license gives you broader rights to the code, it applies to the code. These Terms govern your use of the App distributed through the App Store and the Yapper name and branding.
7. Our intellectual property
The Yapper name, logo, and branding are owned by Gold Penguin. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the App in accordance with these Terms.
8. Availability and changes
We may update, change, suspend, or discontinue features to maintain or improve Yapper, address security or legal requirements, or reflect changes in iOS or third-party services.
9. Disclaimer
TO THE FULLEST EXTENT PERMITTED BY LAW, YAPPER IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, AND NON-INFRINGEMENT. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GOLD PENGUIN AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, OR OPPORTUNITIES, ARISING FROM OR RELATED TO YAPPER. Nothing in these Terms excludes liability that cannot legally be excluded.
11. Termination
You may stop using Yapper at any time by deleting it. Provisions that by their nature should survive, including ownership, disclaimers, and liability limitations, will survive.
12. Apple terms
Your use of Yapper is also subject to the applicable Apple Media Services terms and Apple's standard App Store license terms. Apple is not responsible for Yapper's content, maintenance, or support.
13. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except to the extent the law where you live requires otherwise.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and revise the effective date. Your continued use of Yapper after updated Terms take effect means you accept them.
