These Terms of Service ("Terms") govern your use of the Parky iOS application ("Parky" or the "App"), provided by Gold Penguin LLC ("Gold Penguin," "we," "us," or "our"). By downloading or using Parky, you agree to these Terms and the Parky Privacy Policy. If you do not agree, do not use the App.
1. What Parky provides
Parky helps you browse national parks, save parks, record visits, keep notes and ratings, and create a personal digital park passport. It may also provide maps, images, descriptions, translations, links, and practical information from third-party sources.
2. Personal, lawful use
You may use Parky for personal, lawful purposes. You may not misuse the App, interfere with its operation, attempt unauthorized access, reverse engineer it except where applicable law expressly permits, or use it to violate another person's rights.
3. Your content and data
You retain ownership of notes and other content you create in Parky. You are responsible for that content and for maintaining any backup you need. Parky can create a portable backup through its export feature. iCloud sync depends on your Apple Account, device settings, network availability, and Apple's services. We cannot guarantee that synchronization or backups will always be available or error-free.
4. Park information is not an official advisory
Park descriptions, locations, boundaries, hours, fees, facilities, stamp locations, closures, reservation information, conditions, and other details may be incomplete, approximate, delayed, or outdated. Parky is not a park authority, emergency service, navigation service, or safety advisory. Always verify current conditions, rules, access, fees, permits, and safety information with the responsible park authority before traveling or making decisions.
5. Maps, directions, and outdoor safety
Maps, pins, and directions are provided for general orientation and may be inaccurate. Do not rely on Parky as your sole navigation or emergency tool. Conditions in parks can change quickly. Use appropriate official maps and safety resources, follow posted rules, and exercise independent judgment.
6. Third-party services and content
Parky can display or link to content and services provided by Apple, Wikimedia Commons, Wikipedia, park authorities, and other sources. Their services and content are governed by their own terms, licenses, and privacy policies. Source and license attribution is presented in Parky where applicable. We do not control and are not responsible for third-party services, websites, availability, or content.
7. Our intellectual property
Except for your content and identified third-party content, Parky—including its software, branding, interface, original graphics, and organization—is owned by Gold Penguin or its licensors and protected by applicable intellectual-property laws. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the App in accordance with these Terms.
8. Availability and changes
We may update, change, suspend, or discontinue features to maintain or improve Parky, address security or legal requirements, or reflect changes in third-party services. We do not promise that every feature or external resource will remain available.
9. Disclaimer
TO THE FULLEST EXTENT PERMITTED BY LAW, PARKY IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, AND NON-INFRINGEMENT. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GOLD PENGUIN AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, OR OPPORTUNITIES, ARISING FROM OR RELATED TO PARKY. Nothing in these Terms excludes liability that cannot legally be excluded.
11. Termination
You may stop using Parky at any time. We may suspend access if you materially violate these Terms or if necessary for security or legal compliance. Provisions that by their nature should survive termination—including ownership, disclaimers, and liability limitations—will survive.
12. Apple terms
Your use of Parky is also subject to the applicable Apple Media Services terms and Apple's standard App Store license terms. Apple is not responsible for Parky's content, maintenance, or support.
13. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except to the extent the law where you live requires otherwise.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and revise the effective date. Your continued use of Parky after updated Terms take effect means you accept them.
